DO YOU KNOW TENANTS HAVE RIGHTS DURING FORECLOSURE?

I wanted to share this law that many residential tenants with or without leases may not be aware of: NOTICE TO RESIDENTIAL TENANTS OF RIGHTS DURING FORECLOSURE

APPENDIX XII-K ADOPTED NOVEMBER 17, 2009

UNTIL OWNERSHIP F THE PROPERTY CHANGES OR YOU ARE OTHERWISE INFORMED BY THE COURT OR THE MORTGAGE HOLDER, YOU SHOULD CONTINUE TO PAY RENT TO THE LANDLORD OR TO A RENT RECEIVER, IF ONE IS APPOINTED BY THE COURT. YOU SHOULD KEEP RECEIPTS OR CANCELED CHECKS OF YOUR RENT PAYMENTS. IF YOU ARE NOT SURE HOW OR WHERE TO PAY RENT, SAVE YOUR RENT MONEY SO THAT YOU WILL HAVE IT WHEN THE OWNER DEMANDS IT. NONPAYMENT OF RENT IS GROUNDS FOR EVICTION.

FORECLOSURE ALONE IS GENERALLY NOT GROUNDS TO REMOVE A BONA FIDE RESIDENTIAL TENANT. TENANTS WHO WANT TO STAY IN THEIR HOMES CAN BE REMOVED ONLY THROUGH A COURT PROCESS. WITH LIMITED EXCEPTIONS, THE NEW JERSEY ‘ANTI-EVICTION ACT’ PROTECTS RESIDENTIAL TENANTS’ RIGHTS TO REMAIN IN THEIR HOME. THIS LAW INCLUDES PROTECTION FOR TENANTS WHO DO NOT HAVE WRITTEN LEASES.

IT IS UNLAWFUL FOR ANYONE TO TRY TO FORCE YOU TO LEAVE YOUR HOME OUTSIDE THE COURT PROCESS, INCLUDING BY SHUTTING OFF UTILITIES OR FAILING TO MAINTAIN THE PREMISES.

So be advised that you have protection. Share this with anyone who may be worried or asking. This will help them tremendously.

What Happened with California Commons?

To be perfectly honest, I don’t know. I have received some inquiring posts on my blog and I have spoken to Robert Kahan who heads the company who told me that I could call him back in a day or two and I would be given more information, however, when I did call no one picked up and no one responded to the message I left.

I am just as baffled as everyone else and as soon as I can make contact with the office and speak to someone who can tell me what is going on, I will post it here.

THE NEW MISS AMERICA 2014!

Well Atlantic City has done it. Atlantic City has crowned a New Miss America – Miss New York – Nina (my sister’s name) Davuluri. Although there seems to be a lot of racist banter about her East Indian heritage, she was born in America and in New York.

I don’t know about you guys, regardless of who won, I am glad to see the Miss America pageant Back in Atlantic City, NJ—where it belongs.

MISS AMERICA PARADE IS COMING!

Welcome back after Labor Day. I hope everyone enjoyed their weekend and now back to work and school.

Yes the Miss America Parade is coming to Atlantic City on September 14, 2013. Finally, MISS AMERICA IS HOME where she should be and should have never left.

But I digress! There is a buzz here with I think I can everyone welcoming back the Miss America Pageant.
